1. Acceptance of Terms

By accessing or using Potkasts ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including visitors, registered users, and subscribers.

2. Description of Service

Potkasts is an AI-powered platform that converts text content into Dutch podcast discussions. The Service includes:

• Content-to-podcast generation using Claude AI
• Multiple Dutch text-to-speech voices
• Various discussion format options
• Podcast hosting and streaming
• User account management
• Subscription and payment processing

3. User Accounts

3.1 Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of unauthorized access
• Be responsible for all activity under your account
• Be at least 16 years of age

3.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Subscriptions and Payments

4.1 Subscription Plans

We offer multiple subscription tiers with different credit allocations. Subscription fees are charged monthly in advance.

4.2 Credits

• One credit equals one generated podcast
• Credits are deducted upon successful generation
• Unused credits expire at the end of each billing cycle
• Credits are non-transferable and non-refundable

4.3 Billing

• Payment processing via Stripe
• Automatic renewal unless cancelled
• Price changes communicated 30 days in advance
• All prices in EUR include VAT

4.4 Cancellation

You may cancel your subscription at any time. Access continues until the end of the current billing period. No refunds for partial periods.

5. Content and Intellectual Property

5.1 Your Content

You retain all rights to content you submit. By using the Service, you grant us a license to:

• Process your content through AI models
• Generate podcasts based on your content
• Store and deliver generated podcasts
• Display published podcasts on our platform

5.2 Our Content

The Service, including software, design, and branding, is owned by Potkasts and protected by copyright, trademark, and other laws.

5.3 Generated Podcasts

You own the podcasts generated from your content. We do not claim rights to your generated podcasts, but you are responsible for ensuring your source content respects third-party rights.

6. Acceptable Use

You agree NOT to:

• Submit illegal, harmful, or offensive content
• Violate intellectual property rights
• Generate spam or misleading content
• Attempt to reverse engineer the Service
• Abuse or overload our infrastructure
• Share account credentials
• Use the Service for unauthorized commercial purposes
• Submit content containing hate speech, violence, or harassment

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may:

• Perform maintenance with reasonable notice
• Modify or discontinue features
• Impose usage limits to ensure fair access
• Temporarily suspend service for security reasons

8. AI-Generated Content Disclaimer

Podcasts are generated using AI (Claude) and text-to-speech technology. While we strive for quality and accuracy, AI-generated content may contain errors, biases, or inaccuracies. You are responsible for reviewing generated content before publication or distribution.

9. Limitation of Liability

To the maximum extent permitted by law:

• Service provided "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Total liability limited to fees paid in the past 12 months
• We are not responsible for third-party service interruptions

10. Indemnification

You agree to indemnify and hold Potkasts harmless from claims arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

11. Changes to Terms

We may modify these Terms at any time. Significant changes will be communicated via email or service notification. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Netherlands and the European Union. Disputes shall be resolved in the courts of the Netherlands.
